Says federal law on such unsolicited ads is unconstitutional

In a little-noticed case that could have major implications for users of fax machines, a federal judge in Missouri has ruled that a federal law banning unsolicited fax advertisements is unconstitutional.
The ruling by US District Judge Stephen Limbaugh applies only to the eastern half of Missouri, and Missouri Attorney General Jeremiah ''Jay'' Nixon has vowed to appeal.
''We're disappointed that consumers and small businesses would have to bear the cost of junk fax advertising that they neither asked for nor want,'' said Schott Holste, a spokesman for the attorney general. Supporters of the fax ad ban say Limbaugh's ruling is eccentric and destined for quick reversal.
But Mary Ann Wymore, an attorney for Fax.Com, the defendant in the Missouri case, said Limbaugh's ruling is a First Amendment victory for commercial free speech.
The case began in 2000, when the State of Missouri filed suit against California-based Fax.Com and Texas-based American Blast Fax. The two companies send thousands of ads to businesses and consumers through fax machines. This activity was banned by the Telephone Consumer Protection Act, a 1992 law that forbade the faxing of advertisements to people who had not asked to receive such ads.

Supporters of the ban on fax ads scoffed at Limbaugh's ruling.
Robert Biggerstaff, an engineer and self-trained attorney who last year published an article on the TCPA in the Connecticut Law Review, said most TCPA cases are filed by individuals and businesses in local small-claims courts, where Limbaugh's decision has no force.
''It will be used to confuse small-claims court judges,'' Biggerstaff said. ''Other than that ... it will have practically no legal impact.''
