The jurors did their job; the judge didn't do his. He could have easily sentenced Janklow to at least five years in state prison - NOT jail! - to make him see "how the other half lives," several hundred hours of community service, the maximum in fines - which he apparently didn't even do! - AND enhanced court costs for dragging this matter out and costing the taxpayers the expense of a trial.

As a Republican prosecutor, I have only one comment on this sorry travesty of justice: it's cases like this that add credit to the argument that justice in America IS only for the wealthy and powerful. Maybe minimum sentencing laws aren't so improper after all. Right, Senator Kennedy?

One question - does this man still have the right to drive? I see no mention in the press of his having lost his license - 100 days in jail is bad enough, but if he is ever allowed behind the wheel of a car again, the sentence will be a complete joke.

From today's NY Times: "After 30 days behind bars, Mr. Janklow will be allowed to leave jail during the day for up to 10 hours to perform community service. After he completes his jail term, he will be on probation for three years, during which he will not be allowed to drive."

Taxpayers Would Pay in Janklow Lawsuit
